Reduction in Support Work Force

 

A.        When, in the judgment of the Board, a layoff should occur in any of the classifications set forth in the Wage Schedule located in the Support Staff contract, the affected employee(s) shall be laid off in inverse order of seniority; provided, however, that the remaining employees are qualified and capable of performing the work to be done.  Any employee being laid off shall be given a written notice of layoff fifteen (15) school days in advance of the effective date of layoff.

 

B.         In the event of a layoff, the seniority of an employee shall terminate:

 

  1. If the employee is not recalled within the number of months equal to the employee's continuous months of service, in the case of an employee who has worked for the district less than eighteen (18) months prior to the effective date of layoff;

 

      2.   If the employee is not recalled within eighteen (18) months, in the case of an employee within eighteen (18) or more months of seniority.

 

C.         No new employees shall be hired if there are employees with seniority on layoff status who have   the qualifications and ability to fill the position.

 

D.        Loss of Seniority:  Seniority and the employment relationship shall be broken and terminated if an employee:

 

1.   Quits;

 

2.   Is discharged;

 

3.   Is absent from work for three (3) consecutive working days without notification to and  approval by the District, unless unable to notify for physical or other reasonable excuse;

 

4.   Fails to report to work within five (5) working days after having been recalled from layoff unless physically unable to report to work or for other reasonable excuse;

 

5.   Fails to report to wok at the termination of a leave of absence;

 

6.   Accepts other employment without permission while on leave of absence for personal or health reasons; or,

 

7.   Retires.
